In a recent development, the Federal High Court in Lagos has issued an order granting the suspended Central Bank of Nigeria (CBN) Governor, Godwin Emefiele, permission to serve the Director General of the Department of State Services (DSS), Mr. Yusuf Bichi, with the court’s ruling regarding Emefiele’s bail and remand in custody.
The trial judge, Justice Nicholas Oweibo, approved the ex-parte application presented by Emefiele’s counsel, Mrs. Ogonnaya Sonuga, leading to the issuance of the order. The court had previously granted Emefiele bail in the sum of N20 million on July 25, 2023, after his arraignment on two charges of illegal possession of firearms. However, the DSS re-arrested Emefiele immediately after the court proceedings.
In the recent hearing, Emefiele requested the court’s permission to serve the complainant (DSS) with the order obtained on July 25, 2023, through the office and person of Mr. Yusuf Bichi, by publishing it in the media. Justice Oweibo granted this request and ordered the necessary actions to be taken.
An affidavit in support of the application, sworn by Adeogun Samuel from the law firm of Victor Opara, SAN, stated that despite the court’s bail order on July 25, 2023, the DSS re-arrested and took Emefiele away from the court premises, making it practically impossible to serve the DSS personally. The affidavit emphasized the importance of bringing the court’s order and ruling to the attention of both the complainant and the respondent for prompt action.
The court’s decision to grant this application aims to ensure the fair administration of justice and prevent prejudice to the complainant.
